On December 9, 2022, the jury returned a verdict in favor of the Plaintiffs on their breach of contract claims against Kansas City Life and found damages in the amount of $28,362,830.96. It is expected that Kansas City Life will appeal after the conclusion of post-trial briefing and once a judgment is entered, but it is difficult to predict when the appellate court might decide the appeal.
• On August 24, 2023, the Court entered Final Judgment. On September 1, 2023, KC Life filed a Notice of Appeal, among other reasons, regarding the Court’s grant of summary judgment in favor of the Class on the contract claims and denial of KC Life’s motion for summary judgment, the Court’s certification of the class, and the Court’s denial of KC Life’s motion for judgment notwithstanding the jury’s verdict. On September 11, 2023, Plaintiff filed a Notice of Appeal regarding the Court’s denial of an award of prejudgment interest.
